APATHY AND INACTION ON PART OF PMC COMPELS BANER - PASHAN LINK ROAD RESIDENTS TO MOVE BOMBAY HIGH COURT




After several silent protests, signature campaigns, regular meetings with MLA´s, Corporators, Municipal Commissioners, various office bearers of PMC and after dozens of representations since 2014 by the residents of Baner Pashan Link Road region, the authorities haven´t been able to complete the 36mtr wide Baner Pashan Link Road. No stone has been left unturned by the residents of the region, to have the incomplete DP road completed, however sans any success!

Therefore, left with no other option, Baner Pashan Link Road Welfare Trust (BPLRW Trust) representing the residents of the region has approached the Bombay High Court to challenge the status quo.

The Baner and Pashan neighbourhoods are currently connected through only one narrow dangerous road which is at the moment barely about 7 meter wide, which has no scope of widening as there are pre-existing developed private properties. Development Plan for Pashan was prepared by Pune Municipal Corporation and sanctioned by the Urban Development in 1992 and the 1.2 Km long 36-Meter-wide DP road connecting Baner and Pashan was sanctioned in the said Development Plan. Though the connectivity from Baner, Balewadi to Pashan, West and South Pune, national highway to these suburbs is heavily dependent on the proposed DP road, it is remaining in an incomplete state even after 30 years. The road has been partially constructed in year 2014 and is existing from both the ends but two stretches collectively of approx. 200 Meters are remaining incomplete rendering the entire 1.2 Km long road inutile. Even after several representations, meetings with the Authorities and Elected representatives by the Baner Pashan Link Road Welfare trust office bearers, there is complete inaction from the Pune Municipal Corporation and other authorities since past 8 years. PMC has cited difficulty in acquiring land from private landowners. The PMC has authority to acquire the land for completing the said DP Road. The issue is affecting over 250,000 residents of the region and the residents of Pune at large. The BPLRW Trust is challenging such inaction by Pune Municipal Corporation.


Despite years of continuous follow ups, meetings with authorities & agitations by residents, the 36mtr wide BPLR DP road is yet not completed by PMC, this is a cause of huge concern for thousands of citizens. Due to PMCs failure to develop necessities like roads we citizens are suffering, therefore, to get the road completed in a timebound manner we have decided to knock the doors of Hon High Court for justice.

In 2005 when we booked a flat in BPLR area we envisioned this place being close to Pashan and Baner via the planned 36mtr wide DP link road. It's been over 10 years that we are staying here and still there is no progress on the link road. The ends got developed at huge cost, but the link is missing. As a citizen we have been paying regular taxes, we patiently participated in all meetings with PMC and elected representatives to study and support this road development. The absence of the DP road has led to other missing basic public facilities like well-lit road, public bus service, garbage management etc

Speaking on behalf of the Petitioner Satya Muley, Advocate Bombay High Court said “The fundamental Right to Life under Article 21 of the Constitution of India guarantees full enjoyment of life, which includes the right of enjoyment of proper roads, streets. The Hon´ble Supreme Court has held - Right to life, includes civic amenities like roads etc. Without proper roads and streets, there is hindrance for the population at large to exploit their full potential of life and as the BPLRW Trust & the residents of the region have exhausted all other remedies, they are moving the Bombay High Court to enforce their fundamental rights” Satya Muley
